1. Acceptance of Terms

• Chargebacks or payment disputes
• Verbally abusive or threatening behavior toward staff or other users
• Failure to comply with responsible gaming policies or self-exclusion agreements

Upon termination, all rights granted to you under these Terms will immediately cease. pgwin reserves the right to withhold or confiscate any funds in your account in cases of suspected fraud, terms violations, or pending investigations.

6.3 Dispute Resolution

Disputes not reported within this timeframe may not be investigated. pgwin will investigate all legitimate disputes and provide a written response within a reasonable timeframe.

9. Limitation of Liability and Disclaimers

• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PGWIN DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, pgwin's liability shall be limited to the maximum extent permitted by law.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the appropriate courts of the Philippines.

You agree that any claim or dispute you may have against pgwin must be resolved exclusively through binding arbitration in accordance with the Philippine Arbitration Law, except that either party may bring suit in court to seek injunctive or other equitable relief. 11. General Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy, Responsible Gaming Policy, and any other policies or guidelines posted on the Platform, constitute the entire agreement between you and pgwin regarding your use of the Platform and supersede all prior or contemporaneous communications and proposals.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.

11.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. pgwin's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms or your account to any third party without pgwin's prior written consent. pgwin may assign or transfer these Terms and any or all of its rights and obligations hereunder to any third party without restriction.

11.5 Force Majeure

pgwin shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
